Probearbeitsvertrag: Einstellung rechtssicher testenProbationary Employment Contract: Testing Hires Legally

A correctly drafted probationary contract prevents exactly that.

kurz gesagt

Was in den Vertrag gehört

in short

  • A probationary employment contract is a solution, not a risk. German law recognises probation as a valid substantive reason for a fixed term; the employment relationship then ends automatically when the term expires.
  • Two elements decide between protection and a trap. Only the written fixed-term clause is mandatory. The right to ordinary notice during the term is optional; without it you cannot give ordinary notice before the term ends (section 15(4) TzBfG). Explicitly stating the probation reason is recommended documentation but is not a validity requirement for the fixed-term clause.
  • Written form before the first working day. Missing this deadline risks the creation of a permanent employment relationship by operation of law.

Three weeks after hiring, onboarding goes wrong. Noticed too late, no documentation, no way out. That is exactly what happens when a probationary employment contract is not set up correctly from the start. The fixed-term probationary relationship gives you a legally sound way to test new employees under real conditions. Someone who is convincing in an interview can still struggle in day-to-day work. The interview shows only a part of the picture.

The German Part-Time and Fixed-Term Employment Act explicitly recognises probation as a valid substantive reason for a fixed term under § 14 para. 1 sentence 2 no. 5 TzBfG. The employment relationship ends automatically when the agreed term expires, with no notice required, provided the contract is correctly drafted.

Important: written form is mandatory. The contract must be signed before the first working day. Missing this deadline risks the fixed-term clause being invalid, which means the employment relationship may be treated as concluded for an indefinite period.

Why template contracts often fall short

Many freely available templates omit or phrase these clauses imprecisely. If either is missing you lose the protection the probationary contract was designed to give. A typical pattern: the contract includes a fixed term but no reference to the probation reason. The absence of an explicit reference does not automatically void the fixed-term clause (BAG 7 AZR 549/14, para. 34), but without any documented basis for the substantive reason a labour court may classify the fixed term differently.

What belongs in the contract

Clause 1: fixed term for probation with a determined or determinable end date. The fixed-term clause itself must be in writing before the first working day, as required by § 14 para. 4 TzBfG. The probation reason need not be stated explicitly in the contract (BAG 7 AZR 549/14, para. 34), but explicitly citing § 14 para. 1 sentence 2 no. 5 TzBfG is recommended as documentation practice to avoid later classification questions.

Clause 2 (recommended): right to ordinary notice during the term. Without this clause you are bound until the end date even if it becomes obvious after two weeks that the arrangement is not working. The clause protects both sides.

Model wording: "The employment relationship is entered into for a fixed term of … weeks/months from … to … (or until a determinable event) for the purpose of probation. The fixed term is based on § 14 para. 1 sentence 2 no. 5 TzBfG. The employment relationship may be terminated by ordinary notice by either party."

What should be documented during probation

A probationary employment contract only gives full protection when you actively manage the probation period. Onboarding progress, specific tasks and feedback conversations should be written down, not to create pressure but to have a solid basis if a conversation about ending the relationship becomes necessary.

Hold at least one interim conversation in the first half of the term to discuss the current situation openly. That gives both sides time to correct course or reach clarity.

Checklist before the first working day

  • Contract includes a fixed term for probation with a specific start and end date.
  • Probation as reason for the fixed term under § 14 para. 1 sentence 2 no. 5 TzBfG is stated in the contract (recommended as documentation, not required for validity of the fixed-term clause).
  • Ordinary notice during the term is agreed.
  • Signed contract is with both you and the new employee before the first working day.
  • A date for the first interim conversation is booked.

Three questions to ask

  • Does your contract draft include the probation reason with the specific statutory reference?
  • Is the signed contract in place before the first working day?
  • Do you know what documentation is useful if you want to end the arrangement before the term expires?

A probationary employment contract is one of the simplest tools to limit hiring risk, but only when drafted correctly. Häufige FragenFrequently asked questions

Wie lange darf ein Probearbeitsvertrag dauern? How long may a probationary employment contract run?

The law does not set a maximum duration as long as the term corresponds to the purpose of probation. Courts have regularly accepted terms of up to six months as appropriate. Longer terms should be reviewed in individual cases.

What happens if the probationary employment contract is not made in writing?

If the written form requirement is not met, the fixed-term clause is invalid. The employment relationship is then treated as concluded for an indefinite period. Termination would only be possible under the general rules, not simply by expiry of a term.

Kann der Probearbeitsvertrag verlängert werden? Can the probationary employment contract be extended?

An extension is only permissible under certain conditions. If a fixed-term probationary contract is extended without a further valid reason, the employment relationship may be treated as permanent. Legal advice is recommended here.
